This always intrigues me as I see so many people talking about "kiddie porn" etc etc

I AM NOT CONDONING KIDDIE PORN

Which rules are we following though ? In England, Scotland and Wales, the Age of consent is 16 years old for both homosexual and heterosexual sex. However, in Northern Ireland, and the Republic of Ireland it's 17. although they are looking to reduce that to 16 in May to bring all the UK in line. Interestingly, the law says that sex is not just intercourse but also includes oral sex and mutual masturbation.

I am sure that the age of consent is different in other countries and may even be different in neighbouring states - Is it 18?, 21?, 16?, 14? I have seen all ages banded about across the web. Should the age of consent for porn be higher than the "age of consent"? and if so, why?

Personally for me, it's probably 18 but that puts me at odds with the government. Am I saying 18 because so many young girls look older than they are, or is it because so many older girls can look so much younger? Am I saying 18 because I have a 16 year old daughter?

Then, looking at this site in particular, I am aware that a 16 year old girl posing naked or in a sexual way would make me feel VERY uncomfortable, but it would not break any laws. I am assuming the server is in the US and, therefore US law may apply, but it does all intrigue me at times.

I worry about labelling people based on age. Personally my daughter will not be ready for porn until she is at least 50 and I am long gone. Is it about maturity rather than age, but that plays straight into the ****'s hands. Do we, therefore say its about maturity AND age, and if so, where do we draw the maturity line?

So many double standards in life, and none more so than in this arena
 
There's nothing wrong with discussion based on location and age consent, but there are dumbasses who think it's an invitation to post kiddie porn. Or Fake images of kids, etc.

..and if they try it they should bear in mind that a) they will get banned, b) every decent person will jump all over them and c) the IP address is always there

Generally a site is driven by the law in the country in which they are physically located and, AFAIK, the AoC in the U.S. is entirely independent from the legal age for explicit images which is a different set of laws.

Whicj makes it even more confusing does it not? If the age of consent is 16 but the "explicit images" age is higher, how would that stand up if challenged in court? I can get married at 16, have sex at sixteen but can't take photos of it until I am 21 ?

No wonder we are all screwed up
 
The age of consent in the US is controlled by state law so it varies.
The age for sexual(not necessarily explicit incidentally) images is 18 determined by federal statute and it has been supported by the courts, right up to the Supremes, many times. It's the law used for almost all child porn violations.

Actually the law specifically states that simulated, animated , faked, whatever depictions of under 18 in sexual situations is illegal. I beleive it was upheld by the supreme court also, although it may only be at the appelate level. The lack of willingness to prosecute hollywood or mainstream media for this is deplorable and hypocritical, IMHO, and has no basis in law. It could be that the government doesn't want to take on the big money guys in court for fear of losing the case ultimately. Either way, it's not right to apply the law as selectively as they do.

Very true RO and it was upheld in the Supreme Court.
 
No it doesn't and we don't have a Supreme Court!
